Welcome to Salt and Sun The Label ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of our website, saltandsun.shop (the "Site"), and the purchase of our clothing and jewellery products ("Products"). By accessing or using our Site, you agree to comply with and be bound by these Terms.

2.1 By using this Site to browse, select, or purchase Products, you agree to be bound by these Terms.
2.2 You must comply with all applicable laws when using the Site or placing an Order.
2.3 You must not use any data or content from the Site for commercial purposes (including scraping or data mining) without our written permission.
2.4 The Site is for your personal, lawful use only. You must not use the Site for fraudulent, unlawful, or prohibited purposes. You may not copy, reproduce, modify, or distribute any material from the Site without our prior written consent.
2.5 When using the Site, you must not:
2.5.1 break any laws, infringe others’ rights, or submit false or misleading information;
2.5.2 harass, threaten, defame, or interfere with other users, or post spam or bulk communications;
2.5.3 impersonate another person or use someone else’s details without permission;
2.5.4 post or share offensive, obscene, or unlawful material;
2.5.5 tamper with or disrupt the Site, or upload viruses, malware, or harmful code;
2.5.6 use automated tools (like robots, spiders, or scrapers) to access or copy the Site;
2.5.7 attempt to reverse engineer or alter any part of the Site;
2.5.8 remove or alter copyright, trade mark, or other notices on the Site;
2.5.9 create fake or automated accounts, or attempt to access systems without authorisation;
2.5.10 overload the Site with unreasonable traffic or activity;
2.5.11 use the Site if you are under 18, cannot form a binding contract, or are suspended from the Site;
2.5.12 fail to pay for Products ordered under your account;
2.5.13 transfer your account to someone else without our consent; or
2.5.14 collect information about other users without their consent.
3. Eligibility
3.1 You must be at least 18 years of age to purchase Products from our Site.
3.2 If you are under 18, you may use the Site only with the involvement of a parent or guardian.
4. Orders and Payment
4.1 All orders placed through our Site are subject to acceptance and availability.
4.2 Prices are displayed in Australian Dollars (AUD) and are inclusive of GST where applicable.
4.3 We accept payment through the methods listed at checkout.
4.4 Once an order is placed, you will receive an order confirmation email. This confirmation does not constitute acceptance; your order is accepted once dispatched.
5. Shipping and Delivery
5.1 We only ship orders within Australia. Shipping times are estimates only and may vary.
5.2 We aim to dispatch orders within 2–4 business days of purchase. During busy periods such as sales or promotions, dispatch may take up to 10 days.
5.3 Shipping fees:
5.3.1 Standard shipping is a flat rate of $9.95.
5.3.2 Express Post is available for $16.95.
5.3.3 Orders over $150 qualify for free standard shipping.
5.4 By placing an Order, you:
5.4.1 acknowledge that any person at the delivery address who accepts the Products is authorised by you to do so; and
5.4.2 agree to follow the delivery requirements set out below, or as otherwise notified when placing your Order.
5.5 Unless you provide express authority for the carrier to leave your Order unattended, an appropriate person must be present at the delivery address to accept it. If you do provide authority to leave:
5.5.1 you accept all risk of loss, theft, or damage from the time the Order is delivered; and
5.5.2 you acknowledge that the delivery driver retains discretion as to whether the Products are left unattended.
6. Prices, Fees and Charges
6.1 You agree to pay the purchase price of each Product you order, along with any applicable delivery fees and other charges specified in these Terms.
6.2 All prices and delivery fees are listed in Australian dollars (AUD). We may change prices or fees at any time before you place your Order.
6.3 The purchase price of each Product will be the price displayed on the Site at the time you place your Order.
6.4 If you buy Products as part of a special promotion (such as a bundle or value pack) and later return one or more items, any refund or exchange value will be recalculated to reflect the adjusted purchase.
6.5 If a Product’s price decreases after you place your Order, we are not obliged to refund you the difference.
6.6 We are not responsible for delays or failure to perform our obligations where the cause is beyond our reasonable control (for example, natural disasters, strikes, supply chain disruptions, or transport delays).
7. Warranty
7.1 Jewellery Warranty
7.1.1 All jewellery purchased from Salt and Sun The Label comes with a 90-day warranty against manufacturing defects.
7.1.2 This warranty covers issues such as faulty clasps, broken chains, loose settings, or defective plating.
7.1.3 This warranty does not cover:
- damage caused by misuse or accidental breakage,
- normal wear and tear (including scratches, tarnishing, or fading),
- exposure to chemicals, perfumes, or water, or
- failure to follow care instructions.
7.1.4 If a jewellery warranty claim is approved, we will repair, replace, or refund the item at our discretion.
7.1.5 Proof of purchase is required for all warranty claims.

7.2 Apparel Warranty
7.2.1 All apparel purchased from Salt and Sun The Label is covered by a 30-day warranty against manufacturing defects.
7.2.2 This warranty covers defects such as faulty stitching, broken zippers, or fabric flaws present at the time of purchase.
7.2.3 This warranty does not cover:
- normal wear and tear (including pilling, fading, or shrinkage),
- accidental damage, misuse, or alterations,
- damage caused by improper washing, drying, or storage, or
- sizing issues (see our Returns and Exchanges Policy).
7.2.4 If an apparel warranty claim is approved, we will repair, replace, or refund the item at our discretion.
7.2.5 Proof of purchase is required for all claims.

7.3 ACL Rights
These warranties are in addition to, and do not limit, your rights under the Australian Consumer Law (ACL).
8. Returns and Refunds Policy
8.1 Under the ACL, you are entitled to a refund, repair, or replacement if a Product you purchase is:
8.1.1 faulty,
8.1.2 not as described, or
8.1.3 does not perform as reasonably expected.
8.2 Change of Mind:
8.2.1 We do not offer refunds or exchanges for change of mind.
8.2.2 Clothing exchanges: We allow size exchanges for apparel. You are responsible for return shipping and must provide tracking details.
8.2.3 Jewellery: For hygiene reasons, we do not exchange jewellery for incorrect sizing.
8.3 How to Make a Clothing Exchange:
8.3.1 Contact us at saltandsunshop@outlook.com.au within 14 days of receiving your order.
8.3.2 Items must be returned in original condition, unworn, and with all packaging intact.
8.3.3 Return shipping costs are your responsibility unless the item is faulty.
8.4 Refunds:
8.4.1 Approved refunds will be processed back to your original payment method.
8.4.2 Refunds may take up to 10 business days to appear, depending on your bank or payment provider.
8.5 Exclusions:
8.5.1 For hygiene reasons, we cannot accept returns on jewellery, unless faulty.
8.5.2 Sale items may only be returned if faulty.
9. Product Descriptions and Availability
9.1 We take care to ensure our Products are described and photographed accurately.
9.2 Colours may appear differently on your screen compared to in person.
9.3 Availability is subject to change without notice, and we reserve the right to withdraw Products at any time.
10. Intellectual Property
10.1 All content on the Site, including logos, designs, product images, and text, are the property of Salt and Sun The Label unless otherwise stated.
10.2 You may not reproduce, distribute, or exploit our intellectual property without our prior written permission.
11. Disclaimer of Warranties and Limitation of Liability
11.1 We do not guarantee, represent, or warrant that your use of our Site or services will be uninterrupted, timely, secure, or error-free.
11.2 From time to time, we may suspend or withdraw access to the Site without notice.
11.3 Except as required under the ACL, the Site and all Products are provided “as is” and “as available,” without any warranties or conditions of any kind, whether express or implied.
11.4 It is your responsibility to ensure that Products purchased from us are suitable for their intended use. To the fullest extent permitted by law, we accept no liability for injury, loss, or damage resulting from:
11.4.1 misuse or abuse of our Products,
11.4.2 incorrect fitting, handling, or storage, or
11.4.3 failure to follow care instructions provided.
11.5 To the maximum extent permitted by law, Salt and Sun The Label, its officers, directors, employees, contractors, suppliers, and licensors shall not be liable for any direct, indirect, incidental, special, or consequential damages, including lost profits, revenue, savings, or data.
11.6 You agree to indemnify and hold harmless Salt and Sun The Label and its officers, directors, employees, contractors, and suppliers from any claims, damages, or costs (including reasonable legal fees) arising from your misuse of our Products.
11.7 Nothing in these Terms limits or excludes your rights under the ACL. Where liability cannot be excluded, our total liability is limited to the minimum extent required by law.
12. Governing Law and Enforceability
12.1 If any part of these Terms is found to be void, unenforceable, or illegal in a jurisdiction, that part will be severed for that jurisdiction only.
12.2 The remainder of these Terms will continue in full force and effect.
12.3 These Terms are governed by the laws of Queensland, Australia.
12.4 By using the Site, you submit to the non-exclusive jurisdiction of the courts of Queensland.
12.5 Your rights and remedies under the ACL exist independently of these Terms.
13. Risk of Loss
13.1 Risk and title in Products pass to you at the time of delivery to the delivery address you provided.
14. User Submissions and Comments
14.1 If you submit content (such as reviews, suggestions, or entries), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish, and display that content.
14.2 We may, but are not obliged to, monitor, edit, or remove content that we deem unlawful, offensive, defamatory, obscene, or in breach of these Terms.
14.3 By posting or submitting content, you represent that:
14.3.1 your content does not infringe third-party rights;
14.3.2 your content is not unlawful, defamatory, or harmful;
14.3.3 your content does not contain malware or harmful code; and
14.3.4 you will not misrepresent yourself or mislead others about the origin of your content.
14.4 You are solely responsible for the content you submit. We accept no responsibility for content posted by you or third parties.
15. Indemnification
15.1 You agree to indemnify and hold harmless Salt and Sun The Label, along with our officers, directors, employees, contractors, affiliates, and suppliers, from and against any claims, losses, or costs (including reasonable legal fees) arising from:
15.1.1 your breach of these Terms,
15.1.2 your violation of any law, or
15.1.3 your infringement of third-party rights.
16. Privacy
16.1 Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. See our Privacy Policy HERE.
16.2 Certain personal information may be subject to Shopify’s Privacy Policy, which can be viewed HERE. By using the Services, you acknowledge that you have read these privacy policies.
16.3 Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you.
17. Changes to These Terms
17.1 We may update or amend these Terms at any time by publishing the revised version on our Site.
17.2 For accepted Orders, the Terms in effect at the time of purchase will apply.
17.3 For future Orders, the updated Terms will apply. We recommend reviewing the Terms before placing an Order.
18. Your Privacy and Commercial Electronic Messages
18.1 Unless you opt out, you consent to receiving marketing communications (including email, SMS, and online advertising) from us.
18.2 You may opt out of promotional messages at any time by using the unsubscribe link in communications or adjusting privacy settings in your online accounts.
18.3 Essential messages (such as account, order, or safety information) cannot be opted out of.

19. Termination

19.2 The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Waiver; Entire Agreement, Assignment, Limitation of Liability, Indemnification, Governing Law and Enforceability, Privacy Policy, and any other provisions that by their nature should survive termination.

20.1 These Terms are governed by the laws of Queensland, Australia.
20.2 Any disputes will be subject to the jurisdiction of the courts of Queensland.
21. Optional Tools
21.1 You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
21.2 You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
21.3 Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
21.4 We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service
22. Third Party Links
22.1 The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third party sites, you do so at your own risk.
22.2 We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.
23. Relationship with Shopify
23.1 Salt and Sun The Label is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Salt and Sun The Label.
23.2 By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Salt and Sun The Label, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Salt and Sun The Label.
24. Feeback
24.1 If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, “Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use. We may, for example, use our rights under this license to operate, provide, evaluate, enhance, improve and promote the Services and to perform our obligations and exercise our rights under the Terms of Service.
24.2 You also represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback will comply with these Terms. 24.4 You agree that your Feedback will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your Feedback will not contain libelous or otherwise unlawful, abusive or obscene Feedback, or contain any computer virus or other malware that could in any way affect the operation of the Services or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Feedback. You are solely responsible for any Feedback you make and its accuracy. We take no responsibility and assume no liability for any Feedback posted by you or any third-party.

26.3 We do not guarantee, represent or warrant that your use of the services will be uninterrupted, timely, secure or error-free. some jurisdictions limit or do not allow the disclaimer of implied or other warranties so the above disclaimer may not apply to you.
27. Waiver; Entire Agreement
27.1 The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
27.2 These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
